Seslee S. Smith is a partner in the firm’s Commercial Litigation Practice. Ms. Smith has a national practice focusing on the defense of companies in complex litigation with a strong focus on products liability cases and healthcare regulatory matters. She devotes a large part of her practice outside of the courtroom on risk management, development of policies and procedures to minimize claims and litigation risks, and negotiation of complex disputes, both pre- and post-litigation.
In addition to her litigation practice, Ms. Smith advises MMM clients on legal ethics and professionalism issues, including conflicts of interest, duties of confidentiality and loyalty owed to current and former clients and general compliance with the Georgia Rules of Professional Conduct. Since 2013, Ms. Smith has served as ethics counsel at MMM and works closely with the firm’s General Counsel and Deputy General Counsel.
Ms. Smith has served as national counsel for several Fortune 500 companies in products liability multi-district, class action and mass tort litigation. In addition to her experience as national counsel, she has defended companies in large exposure, catastrophic individual product liability lawsuits. Ms. Smith has successfully defended products liability lawsuits involving a variety of products and component parts, including truck trailers, ladders, pharmaceuticals, asbestos, hospital beds, batteries, aerial lifts, medical devices, personal cosmetics, building products, grout sealants, pressure treated wood, and insulation products.
In addition, Ms. Smith actively represents healthcare systems, hospitals and publicly-held healthcare companies in a range of regulatory, compliance and business disputes. Her representation includes Medicare and Medicaid fraud and abuse matters, managed care disputes, and licensure and medical staff disputes. She has extensive experience representing and advising clients, particularly owners and operators of nursing homes, assisted living facilities and personal care homes, in proceedings with administrative agencies, as well as cases in state and federal courts.
After completing a judicial clerkship and working as an associate at a prominent Savannah law firm, Ms. Smith joined MMM in 2000. Earlier in her career, Ms. Smith gained extensive experience representing logistics and freight forwarding (rail and road) companies in federal and state regulatory compliance matters, as well as in the defense of regulatory and civil actions. She has counseled motor carriers in the development and implementation of safety programs and strategies, including driver training, hazardous material hauling and equipment maintenance, designed to avoid and minimize litigation.
Ms. Smith chairs MMM’s Women’s Initiative, which focuses on the recruitment, professional development and retention of women attorneys at the firm. The Initiative also plays an instrumental role in the training of all associates and helps to support the firm’s commitment to diversity.
