Suspension and/or Blocking for the Access to Forest Origin Document - FOD Module

The Federal Environmental Agency (“IBAMA”) published Ordinance No. 01/2017, which provides for the improvement and unification of the procedures of suspension and/or blocking of the access to the Forest Origin Document (“FOD”) module.
 
FOD is an instrument of the National Control System of the Origin of Forest Products (“SINAFLOR”) for the control of transportation and storage of forest products.
 
In this sense, Ordinance No. 01/2017 regulates hypotheses and modalities for the blocking and suspension of the access to FOD module by the user or company.
 
We highlight that the blocking of the access to FOD module it is not exclusively a sanctioning measure, and it may occur in order to IBAMA carry out inspections or obtain information considered necessary.
 
Further, IBAMA must notify the user or company about the blocking of FOD module and, in some cases, shall also notify the licensing environmental agency for adopt the applicable measures.
 
Finally, Ordinance No. 01/2017 also established the hypotheses of the liberation of the referred blocks/suspension and the restitution of credits of forest products.
