Mark advises and assists hospitals, health systems, and other health care providers with respect to payment and compliance issues under Medicare, Medicaid, and health reform laws. He counsels universities and academic medical centers about compliance with federal research grant rules concerning conflicts of interest, human subjects protection, and research misconduct, and he assists them with internal investigations involving alleged violations of pertinent federal regulations or institutional policies.

Beginning in 1980, Mark's practice has centered on health care payment issues arising under state rate setting or federal reimbursement systems. He is a former partner in the Health Care Practice Group of Choate, Hall & Stewart in Boston, where he represented academic medical centers, community hospitals, specialty hospitals, physicians, long-term care providers, laboratories, and other health care entities regarding diverse aspects of Medicare and Medicaid reimbursement, Public Health Service grants, and fraud and abuse laws. He litigated payment appeals at the Provider Reimbursement Review Board, HHS Departmental Appeals Board, and other public agencies, as well as in state and federal courts. He has also defended routine audits by Medicare Administrative Contractors and investigations by the HHS Office of the Inspector General and the Department of Justice.

Mark contracted hepatitis C and HIV from blood transfusions he received in the 1980s due to his hemophilia and was finally forced in 2001 to take a leave from practice. In the years that followed, he succeeded in bringing both conditions under control and also spent the time indulging his aspirations as a painter and writer, winning uneven acclaim from members of his household. He returned to part-time practice in 2006, serving for two years as a reimbursement and compliance consultant to Beth Israel Deaconess Medical Center and its affiliates.

Immediately prior to joining Verrill Dana, Mark was a special consultant to Harvard University, where he worked with the Office of the President and Provost to draft a University-wide policy on faculty conflicts of interest. He also consulted to Harvard Medical School, where he assisted the Office of Research Issues and the University's Office of General Counsel in investigations of alleged research misconduct and conflicts of interest.

Mark continues to find a satisfying outlet for his creative energies in the visual arts, while feeding the left side of his brain with readings in evolutionary psychology, cosmology, and similar fare from his wife Ellen, a program presenter at the Boston Museum of Science.
