Safer Federal Workforce Publishes Update Regarding Court Injunctions Against Federal Contractor Vaccine Mandate
On December 9, 2021, the Safer Federal Workforce Task Force issued a new statement regarding the court orders enjoining implementation of the federal contractor vaccine mandate. The Task Force statement is as follows:
Regarding Applicable Court Orders and Injunctions: The Office of Management and Budget has issued guidance on implementing requirements of Executive Order 14042 while ensuring compliance with applicable court orders and injunctions, including those that are preliminary and may be supplemented, modified, or vacated, depending on the course of ongoing litigation.
Accordingly, the Government will currently not take action to enforce the federal contractor vaccine mandate where the place of performance identified in the contract is in the United States or its outlying areas.
Federal contractor employees, however, must continue to abide by federal agency COVID-19 workplace safety protocols for federal buildings and federally controlled facilities, including, potentially, the obligation for contractor employees working at federal buildings and federally controlled facilities to be either vaccinated or have a negative COVID-19 test within the past three days.
We will continue to monitor developments in the court ordered injunctions and guidance from the Safer Federal Workforce Task Force.
