On October 01, 2020, Law No. 17.471/2020 ("Law") was published providing mandatory implementation of take-back systems ("LR") in the city of São Paulo, by manufacturers, importers, distributors and suppliers ("Parties"), for an extensive list of products and their packaging, such as:
- used and contaminated lubricant oil;
- electronic-products and their components;
- packaging in general, such as food, beverage, personal hygiene products, cleaning products;
- other products, to be determined at the discretion of the competent municipal or State agency;
- expired or used drugs and their packaging.
It is important to highlight that:
- The Parties are responsible for the implementation and operation of the LR within the limits of the proportion of products they sold in the city of São Paulo, according to progressive, intermediate and final goals, established in sectoral agreements or settlements, respecting, at least, the recovery, by December 2024, of 35% of the volume, in mass, of the packages placed on the market in 2023;
- Integrated solutions may be adopted for the implementation and operation of LR systems;
- Parties should maintain the competent municipal agency duly informed.
Further, the LR systems that are already parties to sectoral agreement or settlements signed at federal, regional or state level, should be considered for the purposes of complying with this Law, provided that they are carrying out actions at the municipal level, and that they observe the rules and goals established in the current municipal legislation.
The Law will come into force on December 30, 2020.
