Government of the Russian Federation approved the amendments stipulating liability of the host party for foreign employee



 


Dear Sirs,


The Government of the Russian Federation approved the draft bill on amendments to Code on administrative offences of the Russian Federation and Federal Law “On legal status of foreign citizens in the Russian Federation”.


According to this draft bill the liability for a foreign citizen will be imposed on the host party. Host parties can be both individuals and legal entities which, for example, invite foreign citizens in Russia for labour purposes. So if employer being a host party does not provide the foreign employee with accommodation, monetary assets and possibility to obtain medical treatment such an employer can be subject to fine.


It is assumed that fines will be established as follows: for individuals in the amount of RUR 2 000 – 5 000, for legal entities – in the amount from RUR 400 000 to RUR 500 000.


For the moment no liability is stipulated for those employers who don’t provide proper support to foreign employees. The proposed remedy is primarily aimed against unconscientious employers, who hire foreign citizens for labour activity in Russia and then close down and leave the foreign citizens without due financial and material support in Russia.


We will inform you when the bill is adopted and comes into force.
