Partner at Wardynski & Partners becomes European Commission Expert

Michał Barłowski, a legal adviser and partner at Wardyński & Partners, who heads the firm's Bankruptcy and Restructuring Team, has become a member of the European Commission's expert group dealing with cross-border insolvency.

The newly-created expert group, under the auspices of the EC's Directorate-General for Justice is to support the Commission's project to amend the Council's Regulation (EC) No. 1346/2000 of 29 May 2000 on insolvency proceedings.

“After over 10 years of the regulation being in force, in keeping with its Article 46, the time has come to amend the provisions regulating issues concerning the insolvency of businesses in the EU (excluding Denmark)” says Michał Barłowski. “Despite the many rulings of the European Court of Justice, application of the Regulation provisions still raises controversy in many areas, and its practice often extends beyond the scope of the framework initially envisaged for it. The group of lawyers and practitioners appointed by the EC come from various member states and is to help the Commission in preparing changes to the Regulation.”
