Penelope has over 15 years experience working exclusively in the area of health and ageing, utilising her understanding and experience of having worked in the clinical area as a registered nurse to provide practical, outcome focussed solutions to legal problems.

She has advised on both domestic and international purchases of a number of significant acquisitions in the health and aged care sector, and regularly provides regulatory and commercial advice to significant clients in the sector including government, national operators and national not-for-profit clients.

Her expertise in health extends to the provision of advice on a range of industry specific issues including proactive risk management, treatment of incapacitated patients and drafting of hospital policies. Penelope's clinical experience builds upon her expertise in the management of a broad range of medico legal claims on behalf of both public and private hospitals, medical practitioners and allied health care providers. She has advised in relation to a state wide patient recall following the failure of medical products and has handled a number of sensitive product liability actions arising out of alleged toxic shock syndrome for a large medical products manufacturer.

Seconded to Queensland Health in 2005, during the Queensland Public Hospitals Commission of Inquiry, Penelope worked closely with staff across several districts of Queensland Health and provided 'on the ground' legal advice to staff required to appear before the Inquiry. In 2014, Penelope engaged to act on behalf of three Queensland Health employees in the Queensland Payroll Commission of Inquiry.

Penelope has direct knowledge of the needs of the aged care industry through her involvement as a committee member of Leading Age Services Australia (Queensland) and attendance at regular events of Aged and Community Services Australia.

Restrictions for Queensland Care Workers Based on COVID-19 Vaccination Status

From 4 August 2021, there are differing restrictions placed on the ability of workers in locked down areas in Queensland to attend work in a hospital, aged care or disability setting, even if that work would ordinarily be essential work. Importantly, the Direction is one of the first in Australia to draw a distinction between a vaccinated person (being a person who has received the prescribed doses of a TGA approved COVID-19 vaccination) and an unvaccinated person...
