Aliza is an accomplished and experienced litigator who enjoys a broad commercial litigation practice with an emphasis on consumer protection litigation and related compliance.

Aliza practices nationwide representing clients in all manner of litigation, with a focus on defending financial institutions and retail companies in litigation involving federal and state consumer protection laws, unfair and deceptive acts, and telemarketing laws. A skilled negotiator, Aliza has successfully obtained favorable resolutions on behalf of clients facing significant exposure in consumer claims in both federal and state courts.

Aliza’s significant consumer protection litigation experience makes her uniquely situated to be able to provide real-world compliance advice to clients navigating the myriad consumer protection laws. Aliza regularly advises clients on a variety of compliance issues, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the Fair Debt Collection Practices Act and its state counterparts, the Fair Credit Reporting Act, the Electronic Funds Transfer Act and its implementing regulations, as well as state telemarketing laws and telemarketer registration requirements.

Aliza is a member of the state bars of Texas, New York, Indiana, and Florida. She is also admitted to practice before the U.S. District Courts for the Northern District of Texas, Southern District of Texas, Eastern District of Texas, Western District of Texas, Northern District of Indiana, Southern District of Indiana, Northern District of Illinois, District of Nebraska, Northern District of Florida, Middle District of Florida, Southern District of Florida, Northern District of New York, Southern District of New York, Eastern District of New York, Western District of New York, and the U.S. Court of Appeals, Fifth Circuit.

Relevant Experience

  • Represented national mortgage servicer against hundreds of Telephone Consumer Protection Act claims throughout the country.
  • Represented student loan servicer against dozens of Telephone Consumer Protection Act claims throughout the country.
  • Represented retailers and financial institutions in Telephone Consumer Protection Act class action lawsuits alleging that calls were placed using an automatic telephone dialing system or to phone numbers on the national Do Not Call registry, and successfully negotiated favorable settlements in each case.
  • Defended financial institutions in litigation asserting claims under the Fair Debt Collection Practices Act and Fair Credit Reporting Act.
  • Negotiated favorable settlements for clients facing potentially significant exposure under state and federal consumer protection and unfair and deceptive trade practices act statutes.
  • Regularly advises financial institutions regarding compliance with the Fair Debt Collection Practices Act, Real Estate Settlement Procedures Act, and related policies and procedures.
  • Routinely provides advice to retailers, financial institutions, utilities, hospitality companies, and restaurants chains on compliance with the Telephone Consumer Protection Act, Telemarketing Sales Rule, the federal reassigned numbers database, and state and federal telemarketing and Do Not Call laws, including by reviewing call-to-action campaigns and associated advertising materials, consent and revocation procedures, Telephone Consumer Protection Act and Telemarketing Sales Rule procedures, and developing compliant marketing and collection programs.
  • Conducted an enterprise-wide audit of Telephone Consumer Protection Act consent and revocation processes for large financial institution.
  • Advises financial institutions regarding compliance with the Electronic Funds Transfer Act and its implementing regulations in responding to consumer disputes regarding unauthorized transfers.
