Profile
Andy's practice focuses on antitrust and trade regulation, including merger review, Hart-Scott-Rodino Act filings, government investigations, and private and government antitrust litigation and investigations.
Andy is an associate in the competition practice group in Washington, DC, where he focuses his practice on a range of competition and antitrust matters and litigation, and other complex civil litigation. Andy has represented clients in the energy, death services, retail, hospitality, and aerospace and defense industries.
Andy regularly represents merging parties before the FTC and DOJ in Hart-Scott-Rodino Act filings and Second Requests, including:
- A major restaurant group in its acquisition of a restaurant chain of with over 150 locations nationwide.
- A leading provider of funeral and cemetery services in its $1.4 billion strategic merger being reviewed by the FTC and several state attorneys general.
- One of the world’s largest retail supermarket chains in connection with strategic divestitures reviewed by FTC.
Andy also regularly represents non-party witnesses in FTC and DOJ antitrust investigations and litigation, including:
- A national home improvement retailer in DOJ investigation and litigation regarding the proposed acquisition of GE’s appliances business by Electrolux.
- A purchaser in FTC investigation and litigation regarding the proposed acquisition of US Foods by Sysco.
- A major energy company in federal and local antitrust investigations into industry pricing practices.
Andy is a regular contributor to the firm’s Retail Industry Blog, commenting on topics related to Competition/Antitrust and Consumer Protection.
In addition to his antitrust practice, Andy regularly provides counselling to seniors at the pro bono wills clinic run in conjunction with Legal Services of Northern Virginia.
Relevant Experience
- Represented a leading provider of funeral, cremation and cemetery services before the Federal Trade Commission in investigation into proposed acquisition of another provider of funeral, cremation and cemetery services.
- Defended major energy company in multi-state investigations and litigation alleging fraud, unjust enrichment, and false claims.
- Defended major defense contractor in antitrust action alleging exclusive dealing and other antitrust claims related to a government procurement. Case voluntarily dismissed by plaintiff.
