Amelia Warren is an Associate at ENS in the Banking and Finance practice.

Amelia specialises in the application of various financial sector laws – including the Financial Sector Regulation Act 9 of 2017 (“FSRA”), the National payment System Act 78 of 1998 (“NPS Act”) the National Credit Act 34 of 2005 (“NCA”), the Financial Advisory and Intermediary Services Act 37 of 2002 (“FAIS”), the Banks Act 94 of 1990 (“Banks Act”) and the Financial Intelligence Centre Act 38 of 2001 (“FICA”).

Her experience includes advising on the application of financial sector laws to crypto assets, providing guidance on the affordability assessment requirements imposed on credit providers under the National Credit Act (NCA), and advising on notification and approval requirements for changes of control of financial institutions in terms of the Financial Sector Regulation Act (FSRA). She has also advised accountable institutions on their obligations under the Financial Intelligence Centre Act (FICA) and provided counsel on the licensing and authorization requirements imposed by the National Payment System Act (NPS Act).

In addition, Amelia is also experienced in the beneficial ownership requirements under the Companies Act 71 of 2008, constitutional law issues, the application of the Financial Markets Act 19 of 2012 and insurance legislation.
