Profile

Andrew focuses his practice on patent litigation before federal courts and the US International Trade Commission (ITC) and patent prosecution and post-grant proceedings before the US Patent and Trademark Office. 

His experience includes dozens of federal court intellectual property related litigations and ITC investigations. Andrew also manages design and utility patent portfolios in the US and abroad, and counsels clients and performs due diligence concerning a variety of IP issues. He is knowledgeable regarding a wide range of technologies in the chemical, electrical, and software arts, including automotive electronics, cryptography, data access and control, electric motors, fintech, hybrid vehicle control strategies, immunosuppressant drugs, injection molding, LCD and LED displays and lighting, medical devices, non-imaging optics, pharmaceutical polymorphism, semiconductor structure and fabrication, video analytics, and video streaming.

Andrew was recognized as a Rising Star in Managing Intellectual Property’s IP Stars Handbook (2021). He is an editor of the leading treatise on ITC practice, “Unfair Competition and the ITC: A Treatise on Section 337 Actions,” and a thought leader on a variety of issues, including patent litigation, ITC practice, IPR and other PTAB proceedings, and IP in the metaverse.

In addition to his intellectual property practice, Andrew engages in a variety of pro bono matters, including asylum applications, election protection and voting rights, military veteran affairs, and protective orders for victims of domestic violence.

Representative Experience

  • Manages US and foreign utility and design patent portfolios for a number of companies, along with the preparation and prosecution of utility and design patent applications related to financial, crypto, and blockchain technology.
  • Defended a leading consumer electronics manufacturer in a district court litigation involving patent infringement claims originating from a dispute over the scope of a licensing agreement concerning speech audio coding technologies. Obtained favorable settlement resolving all licensing and infringement issues.
  • Defended a leading electric motor supplier in an ITC investigation where complainant sought to exclude electric power steering motors used by several automakers in the United States. Won claim construction of key disputed patent term, resulting in complainant’s withdrawal of complaint prior to hearing.
  • Defended a leading automaker against allegations of patent infringement relating to hydraulic fluid vehicle tilt control. Obtained favorable claim construction resulting in the stipulated dismissal of all claims and won Federal Circuit affirmance of claim construction.
  • Defended a leading consumer electronics manufacturer in an ITC investigation involving digital transmission and streaming services delivered by televisions, gaming consoles, mobile phones, and DVD/Blu-Ray players. Obtained a favorable settlement as part of a coordinated defense strategy.
  • Obtained a favorable settlement for automaker respondents in an ITC investigation where complainant sought to exclude hybrid electric vehicles from the United States. Defended an abnormally high number of discovery disputes before the ALJ.
  • Defended a leading automaker against allegations of infringement of six patents relating to light emitting panel assemblies. Handled discovery disputes and the preparation of multiple inter partes review petitions used as the basis for a favorable settlement.
