Brett’s practice focuses on securitization and structured finance.

Brett is an associate on the capital markets and securities team. He has represented a number of issuers, borrowers, lenders and underwriters in a variety of corporate finance transactions, including sales and purchases, credit facilities, securitization transactions and conduit financing arrangements. These transactions involve a broad range of assets, including residential mortgage loans, servicer advance rights, residential and commercial mortgage-backed securities, and auto loans.

Brett also has experience in general and complex litigation with a focus on the needs of real estate developers.

Relevant Experience

  • Representation of borrowers and lenders with respect to servicing advance facilities and related note issuances.
  • Representation of borrowers, lenders and investors over private placement issuances involving asset-backed securities.
  • Representation of multinational real estate developer in lease dispute with anchor tenant over a noncompetition clause.
  • Representation of condominium association in dispute over construction defects under the Consumer Protection Act.
  • Representation of multinational real estate developer over dispute with anchor tenant over consent rights involving a countywide redevelopment project.
