Gustavo’s practice focuses on commercial litigation and cross-border disputes, including arbitration and investigations.

Gus handles a wide variety of commercial matters, focusing on cross-border disputes and transnational arbitrations. He counsels clients both pre-and-post litigation on matters of corporate significance, which includes advising boards and other business leaders with respect to legal risks, coordinating the response of domestic and multi-jurisdictional legal teams to these risks and participating in internal investigations. As part of his practice, Gus counsels clients on complex jurisdictional and venue issues, investment and infrastructure disputes (including those arising from expropriation events). He represents clients in connection with tax and real estate disputes and has significant experience representing clients in cross-border investigations and sanctions compliance.

Gus also maintains an active pro bono practice. He currently serves on the boards of Amigos for Kids and Area Stage Company and Theater Conservatory. Gus serves as co-chair of the firm’s Diversity and Inclusion Committee.

Gus is admitted to practice before the US Courts of Appeals for the Second, Seventh and Eleventh Circuits, the US District Court for the Eastern District of Wisconsin, the US District Court for the Southern District of New York, and all US District Courts in Florida.

Relevant Experience

  • Represented leading beverage company in Florida state court action through two-week jury trial and appeal on claims related to termination of distribution agreements in the Dominican Republic.
  • Regularly advises clients on application of US-Cuban sanctions and potential claims under the Helms-Burton Act.
  • Routinely develops sanctions compliance programs for international financial institutions and corporations, covering OFAC, anti-money laundering and sanctions towards Cuba, Nicaragua, Venezuela and others.
  • Represents clients in matters arising under 28 U.S.C. § 1782, seeking discovery in aid of foreign proceedings.
  • Represented REIT in Florida state court claims for breach of note and foreclosure of property in connection with self-storage warehouse facility.
  • Representing client in ICC arbitration related to the purchase of land in Honduras.
  • Represented leading logistics provider in multiple Florida state court claims related to termination of agreements with clients and collection on open invoices.
  • Represented consortium in international arbitration proceedings arising out of expansions of the Panama Canal.
  • Represented a top European bank in connection with lawsuits and ICDR and ICC arbitrations filed on behalf of bank customers seeking recovery from the estate of Madoff’s brokerage firm related to an alleged international Ponzi scheme.
