Profile

Through his nearly 30 years working with clients to protect their interests and mitigate their exposure to risk, Dan used his practical knowledge to advance development, manufacturing, transactional and remediation projects. Dan advised clients on natural resource, waste management and reporting obligations. He also managed PRP groups and members of groups at waste sites and during litigation, under waste cleanup laws. His clients included electric utilities, manufacturers, mining companies, equity investors, lenders and municipalities.

    Significant Accomplishments
    • Represents PRPs in CERCLA cost recovery, contribution and natural resource damage litigation.
    • Represents group of electric utilities at NPL site on east coast estuary; achieved successful results in administrative, federal district court and bankruptcy court proceedings.
    • Represents corporations, utilities and small businesses in CERCLA and RCRA administrative matters.
    • Advises corporations and small businesses on compliance issues arising under federal, state and local environmental laws.
    • Negotiated settlements of CERCLA liability, including de minimis settlements, at more than 200 sites.
    • Represented multi-national mining and manufacturing company in environmental litigation and at Superfund sites throughout the United States.
    • Represented chemical manufacturer in litigation over cleanup and natural resource damages for a century of alleged releases to an urban lake.
    • Negotiates contractual terms and conditions and oversees due diligence in business and real estate transactions.
    • Conducted environmental compliance audits at numerous manufacturing facilities.
    • Experience with document management issues in litigation, including retention, collection, production and spoliation.
