Relevant Experience

  • US DOJ Trial Attorney 1979 to 1985: lead attorney on several major early RCRA and Superfund injunctive relief cases in EPA Regions 4, 5, 6, 7 and 9, including first federal landfill cleanup case, first dioxin case, and major petro-chemical, pesticide and PCB cases; Exceptional Service citation 1981; DOJ participant in revisions to National Contingency Plan and representation on National Response Team; Primary DOJ staff attorney on policy and legislative matters involving Superfund and other environmental statutes from 1984 to 1985.
  • Lead responsible party counsel on Superfund case in which EPA withdrew its remedy and accepted a more cost-effective remedy following receipt of detailed critical comments and completion of a stakeholders process.
  • Lead responsible party counsel in successful objection to Superfund consent decree unfairly favoring a municipality.
  • Several negotiations of settlements with the United States concerning liability for past Department of Defense activities.
  • Several successful negotiations with clients' insurers concerning environmental and toxic tort claims.
  • Representation of several clients with respect to agricultural chemicals releases and regulation, including FIFRA advice.
  • Mediator of successful allocation of substantial Superfund cost recovery liability among several dozen potentially responsible parties.
