David’s practice focuses on environmental and administrative law, with emphasis on Clean Air Act issues. He has experience in compliance advice, enforcement defense, administrative rulemaking, and appellate litigation. Representative clients include electric utility companies, the pulp and paper industry and chemical manufacturers. His experience also includes commercial nuclear power plant licensing proceedings before the US Nuclear Regulatory Commission.

Relevant Experience

• Advised corporations on compliance issues arising under complex environmental laws.
• Represented many of the largest electric utility companies in the country on Clean Air Act enforcement actions concerning alleged violations of the New Source Review provisions.
• Participate in major legislative rulemakings, and subsequent appellate litigation arising out of the Clean Air Act Amendments of 1990.
• Advised major pulp and paper manufacturers in connection with threatened enforcement actions by the US Environmental Protection Agency for alleged violations of the modification provisions of the New Source Performance Standards and New Sources Review program under the Clean Air Act.
• Represented a major chemical manufacturer in a federal enforcement action, resulting in success on summary judgment on “fair notice” grounds.
• Represented a major electric utility company in licensing proceedings before the US Nuclear Regulatory Commission for a nuclear power plant, involving offsite radiological emergency planning and preparedness issues.
