Profile

Eric is an experienced patent litigator with decades of experience in the life science and pharmaceutical arena. He offers clients informed insight into the entire patent lifecycle.

Eric has more than 30 years of experience litigating patents in a wide range of technical fields, with a particular emphasis on life science and pharmaceutical innovations.  He has extensive experience handling ANDA and Hatch-Waxman litigation, and is registered to practice before the US Patent and Trademark Office. 

Eric is admitted to practice before the United States Supreme Court, the US Courts of Appeal for the Federal Circuit and the Fourth Circuit, and the US District Courts for the Eastern District of Virginia and Eastern District of Wisconsin.   

Relevant Experience

  • Obtained a favorable judgment of noninfringement in ANDA litigation related to doxycycline hyclate delayed –release tablets in the US District Court for the District of New Jersey.
  • Obtained three favorable jury verdicts in litigation involving progressive eyeglass lenses in the US District Court for the Southern District of California.  The court ruled that the defendant was guilty of infringement and must pay treble damages and attorney fees.
  • Secured a judgment on behalf of a medical software provider in a patent infringement matter in the US District Court for the Eastern District of Texas that client product did not infringe the patent-in-suit.  The judgment was later affirmed by the Federal Circuit.
  • Secured a significant patent infringement settlement on behalf of a metals manufacturer in patent infringement litigation involving nuclear fuel rods.
  • Secured a significant patent infringement settlement on behalf of leading surgical and wound care products manufacturer in a case involving baby diapers.
