Profile

Rick Humbracht was a partner when he retired at Bradley. Rick had more than 35 years of experience in the fields of insurance, construction, banking, Uniform Commercial Code and commercial arbitration.

Rick’s litigation experience included representing commercial banks, insurance companies, policyholders and others in a broad range of commercial litigation matters. His arbitration practice included FINRA arbitrations, AAA, construction industry arbitration and general commercial matters. Rick was experienced in handling commercial class action litigation.

His insurance practice included interpreting different types of insurance policies, including directors' and officers' liability insurance, errors and omission insurance, business interruption, financial institutions bonds, and CGL insurance. He advised both insurers and insureds in rendering coverage opinions. His litigation practice included representing both insureds and insurers on policy disputes. He also represented insurance agents and brokers in E&O Claims, insurers in claims under CGL policies, and director’s and officer’s policies.

His banking practice included representing banks and other financial institutions in defending UCC and other claims, negotiating loan workouts, liquidation of collateral, collections and responding to third party subpoenas for records. He was involved in representing several mortgage servicing companies in reviewing policies and procedures for their foreclosure firms and defending servicers in mortgage foreclosure litigation.

Rick’s construction experience included having represented the City of Nashville in litigation arising from the construction of what is now known as the Bridgestone Arena. In addition, he represented the construction arm for the City of Nashville in developing the construction and architect’s contracts for the construction of the Titans Stadium. He regularly advised general contractors, owners and lenders relating to issues such as contract preparation, enforcement/termination, lien enforcement, bond claims and litigation and arbitration of disputes.

His arbitration practice was broadly related to construction, securities and general commercial issues. He  arbitrated disputes between broker-dealers and customers, handled on the record interviews with NASD (now FINRA) on behalf of registered reps, and arbitrated construction disputes between owners and general contractors and general contractors and subcontractors. He was active, as well, in arbitrating commercial disputes.

His strong advocacy skills and prudent case management combined to make him an excellent representative of regional and national clients. He understood the needs and demands on in-house counsel in handling litigation matters. Rick practiced before Tennessee trial and appellate courts, as well as federal courts within Tennessee and other jurisdictions.
