Kate represents health care providers and health plans on a wide range of transactional and complex regulatory compliance matters.

She has recently advised clients with respect to health system affiliations and joint ventures involving health systems, health plans, and physician groups. In the regulatory compliance context, Kate regularly counsels hospitals, health plans, and physician groups with respect to matters involving HIPAA/HITECH and state privacy and security laws, the Stark Law and Anti-Kickback Statute, and federal and state licensures and approvals. She also has specific experience representing public and private entities with respect to data collaboratives and big data issues.

Known for her deep health care regulatory knowledge and practical approach in this highly technical field, Kate is skilled at helping health care organizations and other entities navigate complex health care regulatory frameworks and adapt to an evolving legal and business landscape. Her clients trust her to achieve their objectives in compliance with applicable laws and to maintain positive relationships with opposing parties and counsel, who often become business partners at the conclusion of a matter.

Recent representative matters include:

  • Representing health systems and health plans in strategic affiliations, including advice with respect to federal and state regulatory approvals
  • Negotiating a joint venture between a national primary care practice and a national health plan
  • Representing health systems, health plans, and physician group practices in responding to HIPAA and state data breaches, including individual and agency notification obligations, appropriate remediation measures, federal investigations, and corrective action
  • Advising a large health care data repository on HIPAA compliance, including data breach analysis, with respect to a multipurpose health care data warehouse formed among a hospital system, health plan, and physician group practice
  • Analyzing a recent state referendum for compliance with HIPAA on behalf of a state hospital association
  • Developing various data-sharing agreements and advice about the access and use of health data, data policies, secondary uses of data, vendor contracting, electronic data sharing, privacy risk assessments, and data breach responses
  • Counseling a health care purchaser coalition in the negotiation of value-based health care contracts and prescription benefit management contracts

A former Peace Corps volunteer and project director, Kate has a strong record of community service. This includes her participation as counsel to Maine's state-wide health information exchange in the Maine health information technology legal working group, which proposed statutory changes to facilitate the electronic exchange of health information, and as a member of the Maine Hospital Association work group created to review advance directives laws and legal forms.
