Profile

Nathan’s practice focuses on corporate restructuring, bankruptcy, distressed lending transactions, and other insolvency-related matters. He represents corporate debtors, secured lenders, DIP lenders, unsecured creditors, and creditors’ committees in chapter 11 proceedings and out-of-court restructurings. 

Nathan regularly represents and counsels clients on a broad range of in-court and out-of-court bankruptcy and insolvency related issues, as well as in connection with distressed lending transactions and work-outs. He also has experience representing parties in connection with safe harbored financial contracts and related structured finance transactions, including mortgage warehouse repurchase facilities.

Nathan maintains an active pro bono practice, regularly representing individuals that are members of underserved communities, as well as local small businesses, in a variety of matters.

Prior to joining the firm Nathan served as law clerk to the Honorable Kevin R. Huennekens, US Bankruptcy Court for the Eastern District of Virginia. He is admitted to practice before the US Court of Appeals for the Fourth Circuit and the US District and Bankruptcy Courts for the Eastern District of Virginia.

Relevant Experience

  • Represented chapter 11 debtors, including public and private companies, in various industries, including retail, energy, and financial services.
  • Represented secured lenders, DIP lenders, unsecured creditors, and official committees of unsecured creditors in numerous chapter 11 cases.
  • Defended creditors in a variety of bankruptcy-related litigation, including preference and avoidance actions, as well as against claims alleging violations of federal and state consumer protection laws.
  • Represented debtors in appeals before district courts and the US Court of Appeals.
  • Represented purchasers of assets in bankruptcy “Section 363” sales.
  • Represented borrowers in negotiation of mortgage repurchase facilities.
  • Assisted two of the largest publically traded mortgage real estate investment trusts in connection with forbearance of repurchase financing arrangements and related exit/restructuring due to issues stemming from COVID-19 pandemic.
