Profile

Nicole’s practice focuses on compliance and litigation for financial institutions related to consumer protection laws and the Bankruptcy Code.

Nicole has experience advising financial institutions on consumer protection compliance and consumer finance litigation in bankruptcy and federal courts across the country. Her litigation experience includes defense of actions under the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Truth In Lending Act, Telephone Consumer Protection Act Real Estate Settlement Procedures Act, and various state statutes related to consumer credit protection and unfair, deceptive, or abusive acts and practices. Nicole also advises financial institutions as to policies and procedures for compliance with state and federal consumer protection statutes, including how those statutes intersect with the Bankruptcy Code.

Nicole is admitted to practice in New York and Texas, as well the United States Court of Appeals for the Fifth Circuit, and the United States District Courts for the Northern, Southern, Western and Eastern Districts of Texas. Nicole is committed to pro bono service and volunteering in the community. She was awarded the Empire State Counsel Award for her commitment to pro bono service.

Relevant Experience

  • Represented a lender on the appeal of an issue of first impression under Texas foreclosure laws.
  • Defended lenders in consumer litigation relating to mortgage loans against claims under RESPA, TILA, and FDCPA, and for quiet title, wrongful foreclosure, and other related claims.
  • Represented lenders and other clients in real estate disputes related to property lines and title insurance claims.
  • Advised clients on a broad variety of bank regulatory and securities compliance matters, including consumer compliance, third party risk, and compliance management.
  • Defended various financial institutions and entities in bankruptcy litigation matters including preference claims, turnover actions, fraudulent conveyance and transfer claims, and other insolvency disputes.
  • Advised financial institutions in compliance of consumer bankruptcy notification and claim filing process.
  • Defended financial institutions in litigation and contested matters asserting violations of the automatic stay and discharge injunction.
