Profile

Peter’s practice focuses on complex commercial litigation, financial services and real estate litigation, and appellate practice.

Peter has broad experience defending banks and other financial services providers, especially lenders in consumer litigation relating to mortgage loans. Peter’s defense of financial services providers includes complex commercial litigation, consumer class actions and multidistrict litigation. Peter also advises financial services clients on consumer financial compliance issues.

Peter has experience as an appellate practitioner, representing clients on appeal in both federal and Georgia appellate courts. Combining his appellate experience with a commitment to pro bono work, the US Court of Appeals for the Eleventh Circuit recently appointed Peter to represent indigent criminal defendants on appeal.

Peter also has experience in consumer arbitration issues. He has successfully enforced arbitration agreements in both state and federal courts. In addition, Peter has assisted his financial services clients with drafting consumer arbitration agreements and advises his clients on developments in arbitration law.

A former transactional attorney specializing in commercial real estate, Peter has handled a wide range of real estate transactions, including acquisitions, dispositions and office and retail leasing. He applies his background in real estate transactions to real estate litigation matters.

Relevant Experience

  • Defeated several putative class actions against lenders at the motion to dismiss stage.
  • Represented and helped develop litigation strategies for several lenders in class actions regarding overdraft fees.
  • Defended lenders in consumer litigation relating to mortgage loans against claims under RESPA, TILA, and FDCPA, and for quiet title, wrongful foreclosure, and other related claims.
  • Successfully enforced individual arbitration in several putative consumer class actions, including a victory at the Eleventh Circuit resulting in a reversal of the trial court’s denial of a motion to compel individual arbitration.
  • Appointed by the Eleventh Circuit under the Criminal Justice Act to represent indigent criminal defendants on appeal, which includes a recent oral argument before the Eleventh Circuit.
  • Represented lenders and other clients in real estate disputes related to property lines, commercial lease terms, and title insurance claims.
  • Represented a lender on the appeal of an issue of first impression under Georgia lending laws.
