Profile

Rebecca Wicks is a member of the Insolvency & Financial Law Group in the Firm’s Orange County office.  Ms. Wicks focuses her practice on creditors’ rights, insolvency, bankruptcy, and commercial litigation.  She has substantial experience representing debtors, creditors, and committees in bankruptcy cases, including in complex Chapter 11 cases and Chapter 15 matters, as well as adversary proceedings.

In 2024, Ms. Wicks was recognized by Best Lawyers in America, Ones to Watch: (i) Bankruptcy and Creditor Debtor Rights/Insolvency and Reorganization, and (ii) Litigation – Bankruptcy.  Since 2018, Ms. Wicks has served on the board for the Southern California chapter of International Women’s Insolvency and Restructuring Confederation (“IWIRC”) and currently serves as Treasurer.

Prior to joining Buchalter, Ms. Wicks gained experience in complex Chapter 11 cases at top-ranked national firms. She also previously served as a judicial law clerk to the Honorable Eduard V. Rodriguez of the United States Bankruptcy Court for the Southern District of Texas and the Honorable Neil Bason of the United States Bankruptcy Court for the Central District of California.

<ul><li>Represented Borrego Community Health Foundation in its chapter 11 case, which received the <em>ABI</em> Asset Sale of the Year award in 2024, the <em>M&A Advisor’s Restructuring Deal of the Year Award </em>($50 million to $100 million category), the <em>Global M&A Network Americas Distressed M&A</em> <em>Deal of the Year</em> (Lower Middle Markets), and was ranked in the top 10 cases for 2023 by Financial Times for its originality, leadership, and impact in the healthcare and life sciences category</li><li>Represented the Official Committee of Unsecured Creditors appointed in the chapter 11 cases filed by Beverly Community Hospital Association dba Beverly Hospital and its affiliates</li><li>Represented the FDIC in the dismissal of the Chapter 15 petition of Silicon Valley Bank (Cayman Islands Branch)</li><li>Represented the Official Committee of Unsecured Creditors of Easterday Farms in the Easterday Farms chapter 11 bankruptcy case in obtaining a 100-percent recovery for unsecured creditors.</li><li>Prevailed on summary judgment on behalf of a creditor seeking non-dischargeability</li><li>Represented commercial landlord of several fitness center locations in enforcing lease rights and maximizing recovery in the 24 Hour Fitness chapter 11 bankruptcy cases</li><li>Represents secured creditors in relief from stay hearings and negotiation of adequate protection payment plans in chapter 7 and 13 bankruptcies.</li><li>Regularly defends creditors against preference actions and fraudulent conveyance claims.</li><li>Represents creditors in non-dischargeability actions.</li></ul>
