Robert Ziemian builds and enforces intellectual property portfolios in the e-commerce age. Focusing on the unique and compelling aspects of anticipated products he designs protection schemes involving patents, design patents, trade dress, trademarks, and copyrights, resulting in tailored protection for distinctive products. Robert specializes in stopping knockoffs and counterfeits and provides clients a menu of solutions, including e-commerce monitoring and takedowns, cease and desist letters and soft enforcement, and federal district court and International Trade Commission (ITC) proceedings.
Robert enforces patents and trademarks on a global basis and utilizes a diverse set of solutions to solve issues with infringers, especially at the ITC. In 2017, he was the lead attorney that argued for and obtained a General Exclusion Order at the ITC, helping a consumer products client significantly reduce the number of imported knockoffs. In 2018-2019 he was one of the leads for a team of attorneys that asserted three patents in the medical device area. He argued part of the Markman hearing and worked intensively with experts to design testing that would prove infringement. In 2009 he was part of a patent litigation team that successfully settled a major patent infringement action for $70 million, which was one of the top 10 IP wins that year.
Robert has a diverse technological background and has worked prosecuting, enforcing and licensing patents, especially in the areas of consumer products, medical devices, food and beverages, voice coding and data transmission, advanced memory devices, chemical engineering and industrial process flow, automotive technologies, telecom, e-commerce, targeted marketing, software and electronic gaming. His experience focuses on a holistic perspective in patent portfolio-building that includes filing and prosecuting patents, analyzing existing assets and identifying and acquiring new assets. Robert also manages international trademark and design protection portfolios. In trademarks and patents, he focuses on what consumers recognize and desire in products, focusing protection on capturing those aspects. Such protection is targeted to company specific business objectives and is shaped to defend and grow business.
Robert understands the value of patent landscaping and portfolio review and devises numerous innovative solutions when possible to help clients maximize their intellectual property (IP) assets. He has previously worked with a team of top-level scientists and engineers in order to identify and acquire value patents in a variety of fields, including semiconductors, optics, software, telecom, e-commerce, electronic gaming, social networking, and electronics. His past work experiences include positions at entities such as TPL, Inc., Bose, the Navy Office of General Counsel, MWH Global, and Woods Hole Oceanographic Institute.
