Profile

Seth is an experienced litigator who focuses his practice on complex commercial litigation. He handles a variety of disputes, including class actions and claims for breach of contract, breach of fiduciary duty, and business torts, from pre-suit investigation through appeals. As a result, Seth has developed a wide base of knowledge, along with the ability to quickly grasp new subject areas, in order to serve clients in varied locations and industries, including the finance, natural resources, transportation, healthcare and equine sectors. 

Before a case is filed, Seth helps clients analyze the facts and law, examine potential claims and defenses, and determine how to proceed in a way that leverages the best outcomes, whether that be a pre-litigation settlement, the filing of offensive litigation, or going on the defensive. Once a case is filed, Seth utilizes his experience to guide clients through the process from beginning to end, including pleadings, discovery, mediation, motion practice, and trial. In the appellate space, Seth has prosecuted and defended direct appeals from lower courts as well as original writ actions and has participated in briefing on behalf of amicus curiae.

As a zealous advocate for his clients, Seth regularly appears in various circuit and district courts in Kentucky, the Kentucky Court of Appeals, the Kentucky Supreme Court, both of Kentucky’s federal courts, and the U.S. Court of Appeals for the Sixth Circuit. Seth also assists clients with ongoing litigation in other states and has appeared in various state and federal courts across the country.

Outside the courtroom, Seth regularly advises clients regarding contract interpretation, regulatory compliance, nonprofit issues, and business operation. In that vein, he serves as outside counsel for multiple Kentucky for-profit and non-profit entities, managing a nationwide team of attorneys to serve any client needs in any location. He is also pleased to organize the Lexington Name Change Clinic, which offers pro bono name change services. Seth also enjoys writing on complex and cutting-edge legal issues and has authored papers or spoken on panels covering non-competition agreements, LGBTQIA+ rights, and Supreme Court reforms.

Before entering private practice, Seth served as a judicial law clerk for Judge Charles R. Simpson III in the United States District Court for the Western District of Kentucky. He then spent time at a smaller insurance defense firm before joining Dinsmore, which gives him a unique set of skills, perspective, and experience. While in law school, Seth worked in the chambers of Chief Justice P. Harris Hines of the Supreme Court of Georgia and spent summers interning with the United States Department of Justice.
