SENACON Enacts New Ordinance on Companies' Obligation to Register in the Consumidor.gov Platform (Ordinance n° 12/2021, April 5, 2021)

SENACON enacted a new ordinance bringing changes to the list of suppliers who must register in the Consumidor.gov platform, revoking the previous ordinance that regulated the matter.
SENACON enacted a new ordinance bringing changes to the list of suppliers who must register in the Consumidor.gov platform, revoking the previous ordinance that regulated the matter.
The Ordinance expanded the list of suppliers that must register in the platform, which now are: (i) companies with national or regional operations in sectors that involve public services and essential activities; (ii) digital internet service platforms dedicated to the individual or collective transportation of passengers or the delivery of food; (iii) digital platforms and marketplaces that carry out the promotion, offer, sale or intermediation of their own or third-party products, commercialization of advertisements, advertising, as well as connection, application, content and other social networks for profit; and (iv) economic agents listed among the two hundred most claimed companies, annually, in the National Consumer Protection Information System of the National Consumer Secretariat of the Ministry of Justice and Public Security (Sindec).
The Ordinance also establishes that the obligation only applies to companies that, individually or through their respective economic groups: (i) have gross sales of, at least, one hundred million reais in the last fiscal year; (ii) have reached a monthly average equal to or greater than one thousand complaints in their customer service channels in the last fiscal year; or (iii) are claimed in more than five hundred lawsuits that discuss consumer relations up to the last calendar year.
The verification of compliance with the Ordinance will be the responsibility of the General Coordination of the National Consumer Protection Information System.
