AIBIM Leads the Development of Malaysian Schedule for ISDA/IIFM Tahawwut Master Agreement

Our partners, Mr. Rabindra Nathan and Ms. Christina Kow, participated in a refresher course organised by the Association of Islamic Banking and Financial Institutions Malaysia (AIBIM) for its member banks.
They spoke on the issues revolving enforceability of, and selection of governing law for, the Tahawwut Master Agreement (TMA), which was developed jointly by both International Swaps and Derivatives Association (ISDA) and International Islamic Financial Market (IIFM).
We assisted in developing the Malaysian Schedule to the TMA as an option for Islamic banks in Malaysia to undertake Islamic derivatives and hedging transactions under a Malaysian law governed TMA.
The refresher course is a collaboration between AIBIM, ISDA, IIFM, Clifford Chance LLP and our firm to assist AIBIM member banks in their understanding of the adoption of a Malaysian Schedule to the TMA.
