Neora Triumphs over FTC in Landmark Case

Larry Steinberg, chair of the firm’s Multilevel Marketing Group, was featured in the November 2023 issue of Social Selling News, a leading trade publication for the direct selling industry. Larry commented on the significance of the recent decision against the Federal Trade Commission and in favor of multilevel marketing company Neora. In its decision after trial, the court affirmed the legality of Neora’s business opportunity and rejected the FTC’s contention that Neora is an illegal pyramid scheme. In the article, Larry notes that, “Though there is much in this decision to celebrate, this is not time to spike the football.” As quoted in the article, Larry believes that “the biggest takeaway from the court’s decision is that, if a company can prove that its business is primarily driven by retail sales, and if a company devotes the resources necessary for a proactive and robust compliance effort, a court will not simply rubberstamp the FTC’s conclusory and unproven allegation that the business opportunity is a pyramid.”
