Antitrust Trial Victory by Shareholders Joshua Robbins and Roger Scott Named as One of California’s Top Defense Verdicts of the Year
The Daily Journal has named as one of the Top Defense Verdicts for 2023 a complete defense victory that Buchalter Shareholders Joshua Robbins and Roger Scott won for client WhiteWater West Industries, Ltd. in a major antitrust and RICO lawsuit by a competing maker of surfing simulator machines. The case involved the extremely rare jury trial of “sham litigation” antitrust claims, in which WhiteWater—the world’s largest maker of water park rides—was accused of using earlier patent litigation to improperly block competition in the market. While the plaintiff in the case, represented by a prominent antitrust plaintiffs’ firm, had originally sought over $200 million in damages, Mr. Robbins and Mr. Scott, along with co-counsel from Crowell & Moring, obtained a full defense verdict following a two-week trial and a single hour of jury deliberations.
