Greenspoon Marder Partner Franklin Homer Wins Major Victory on Advertising Substantiation Challenge

Boca Raton, Fla. – January 9, 2025 – Greenspoon Marder is pleased to announce that Regulatory Compliance and Defense partner Franklin S. Homer and his legal team prevailed in a multi-month investigation by the Ohio Attorney General’s office concerning a major consumer household electrical product.

Last summer, the Attorney General had accused the private electrical products and services firm, one of the more established in the U.S., of engaging in acts or practices that potentially violated Ohio’s Consumer Sales Practice Act and subsequently issued a Request for Advertising Substantiation. Mr. Homer, representing the client, responded to the request regarding three marketing claims made on the client’s website. After a three-month review period, the Ohio Attorney General’s office provided a letter to Mr. Homer, informing him and the client that the matter was now formally resolved.

Mr. Homer is also a member of the firm’s Litigation practice group, handling an assortment of regulatory, transactional, and litigation matters in the health care, debt settlement, telemarketing, and advertising arenas. He has experience at both trial and appellate levels as well as in handling arbitration. As part of his practice, Mr. Homer has defended clients in highly regulated industries against various Attorneys General, the Federal Trade Commission, and the Consumer Financial Protection Bureau.
