Dinsmore Partners with Ohio Chamber to Propose New Pleading Standard

In collaboration with Tony Long, General Counsel of the Ohio Chamber of Commerce, Dinsmore attorneys Richik Sarkar and Jenna Pletcher recently filed an amicus brief before the Supreme Court of Ohio in Wilson Energy, LLC, et al. v. Redbird Development, LLC, et al., Ohio Supreme Court Case No. 2025-0029. The brief supports a transformative change in Ohio’s pleading standards, advocating for adopting the heightened “plausibility” standard currently employed by federal courts.

This effort represents a significant step toward aligning Ohio’s judicial system with modern legal practices, enhancing judicial efficiency and fostering economic growth. The proposed standard would require plaintiffs to demonstrate that their claims have a plausible basis, helping to reduce frivolous litigation and its associated burdens on litigants.
