Civil Servant Pensions through Sustainable Equities – Heuking Kühn Lüer Wojtek Supports Four German States

July, 2019 - Germany

The German states of Baden-Württemberg, Brandenburg, Hesse, and North Rhine-Westphalia will invest in sustainable equities for their pension funds. They commissioned Stoxx Limited to design and subsequently maintain sustainable share indices for seven billion euros.

Stoxx Limited will consider sustainability criteria and specifications such as CO2 intensity, no nuclear power generation, no production of controversial weapons. “Sustainability is our guiding principle – this also applies to our investments. We invest our assets responsibly, thus profitably, safely, and taking sustainability aspects into account,” said Gisela Splett, Baden-Württemberg’s State Secretary of Finance. “The fact that four German states are joining forces for sustainable investments of this magnitude is a milestone for civil service pensions,” Dr. Ute Jasper, head of Heuking Kühn Lüer Wojtek’s Public Sector & Public Procurement practice group, was pleased to note. “Stoxx prevailed in the competition and will design the new sustainable stock indices before the end of the year,” added Dr. Christopher Marx, who is responsible for contracts and contract processing in the team.

Heuking Kühn Lüer Wojtek supported the project with Dr. Ute Jasper (Lead), Dr. Christopher Marx (Public Procurement and Contracts), Dr. Christoph Gringel and Dr. Thorsten Kuthe (both Contracts and Capital Markets), and Gesa Krohn (Public Procurement). In the past, Dr. Jasper’s team has successfully completed numerous procedures for the state of Baden-Württemberg.

The Public Sector & Public Procurement department led by Ute Jasper has been one of the three best procurement law practices for years. Since 1991, it has advised on awards, restructuring, large-scale projects, and cooperations in the public sector and has accompanied several hundred large-scale projects of the federal, state, and local authorities and their subsidiaries with a total volume of more than EUR 20 billion without any procedures having been successfully challenged.

Dr. Ute Jasper is one of the most renowned lawyers for procurement and infrastructure projects in the public sector. She advises federal and state ministries, municipalities, and businesses, particularly on innovative and complex projects. Ute Jasper heads Heuking Kühn Lüer Wojtek's "Public Sector & Public Procurement" department. For years, she has been ranked number 1 in JUVE Handbook of Commercial Law Firms, most recently in its 2017/2018 issue, and according to "Law Firms in Germany," is the "premier contact on the market" for infrastructure. In October 2016, she received the JUVE Award for Regulated Industries with her team.

Dr. Christopher Marx is a lawyer in the “Public Sector & Public Procurement” practice group, Düsseldorf. His practice focuses on complex and innovative projects in public procurement law as well as the drafting of contracts under civil law.>/i>
