Profile
Naa’ilah Abader is an Executive at ENS in the Employment practice.
She has advised public and private clients in South Africa and in a number of African jurisdictions, including Angola, Botswana, Djibouti, DRC, Egypt, Ghana, Kenya, Lesotho, Mozambique, Namibia, Nigeria, Rwanda, South Sudan, Tanzania, Uganda, Zambia and Zimbabwe.
She has advised clients in a variety of industries, including finance, farming, manufacturing, aviation, telecommunications, media, software, security, retail, technology, pharmaceutical as well as the Independent Regulatory Board for Auditors and the South African Institute of Chartered Accountants.
Naa’ilah’s experience includes advising clients on employment law matters, such as incompatibility and incapacity issues, disciplinary proceedings, as well as labour litigation matters at the Commission for Conciliation, Mediation and Arbitration and the Labour Court, including arbitrations, reviews and trials. She also has significant experience in conducting due diligence exercises, advising clients on transfers of business as a going concern, as well as restraint of trade litigation matters. Naa’ilah regularly advises clients on small and large scale retrenchments. She has also assisted clients with conducting internal investigations and has conducted training for a number of clients on wide range of employment law topics including internal hearings, harassment and POPI. Naa’ilah has been extensively involved in a number of prosecutions for the Independent Regulatory Board for Auditors and the South African Institute of Chartered Accountants in relation to professional misconduct cases. In addition, she has advised regulatory bodies on aspects relating to administrative law. Naa’ilah has experience in and has advised a number of clients in relation to global mobility and remote working arrangements.
