Profile
Elena represents employers in state and federal litigation and advises employers on a wide range of labor and employment compliance matters.
Elena’s practice focuses on employment litigation before administrative agencies and state and federal courts. She has experience representing employers against claims of discrimination, workplace harassment, and retaliation, as well as violations of the Fair Labor Standards Act and Family and Medical Leave Act. In addition, she helps employers comply with federal and state laws and administrative regulations by preparing Affirmative Action Plans, employee handbooks, and policies.
Elena is a contributing author to the Hunton Employment & Labor Law Perspectives blog. Elena also participates in a number of the firm’s pro bono programs including the Virginia Hispanic Chamber of Commerce Wage Theft Clinic.
Relevant Experience
- Defends large corporations in various race, gender, and retaliation lawsuits brought by individual or joint plaintiffs.
- Advises clients in union organizing campaigns, elections, and unit hearings under the NLRB’s new “ambush election” rules.
- Experience defending employers against unfair labor practice charges filed with the National Labor Relations Board.
- Defends numerous charges before the Equal Employment Opportunity Commission and comparable state agencies.
- Prepares Affirmative Action Plans for federal contractors.
- Prepares and revises employee handbooks, employee policies, and related materials.
