Profile

Gabriel represents employers in all aspects of labor and employment law. He defends employers in state and federal court, arbitration and administrative proceedings against a wide range of labor and employment matters, including but not limited to, wrongful termination, FEHA, and class action wage and hour claims.

Gabriel’s litigation practice includes defending employers against allegations of discrimination, harassment, retaliation, wrongful termination, and employment-related tort and contract claims. Gabriel also has experience defending employers in complex wage and hour actions and PAGA representative actions involving minimum wage, overtime, meal and rest, misclassification, wage statement and reimbursement disputes. In addition, he advises clients on compliance with state and federal employment laws.

Relevant Experience

  • Defended multinational ridesharing company in single-plaintiff action alleging disability discrimination, retaliation and wrongful termination.
  • Defended travel agency in multi-plaintiff action alleging sexual harassment, invasion of privacy and tort-related claims.
  • Defended major telecommunications company in wage and hour class action alleging failure to reimburse business expenses and off-the-clock work, meal and rest period violations, and unpaid overtime based on alleged employee misclassification.
  • Obtained dismissal of Equal Employment Opportunity Commission (EEOC) charge against law firm alleging disability discrimination.
  • Defended employers in administrative proceedings against wage and hour claims.
  • Successfully represented employers in California Department of Fair Employment and Housing (DFEH) and EEOC investigations.
