Profile

Jayde represents corporate clients in all aspects of employment matters arising under federal and state law, including, but not limited to, Title VII, the FLSA, the FMLA, the ADA and the ADEA.

In addition to litigation, Jayde advises employers on best practices relating to hiring and termination decisions, employment policies and workplace investigations. Jayde also prepares and negotiates separation and release agreements, employment contracts and independent contractor agreements, and non-competition and confidentiality agreements. In addition, Jayde counsels clients regarding labor and employment obligations and representations in connection with mergers and acquisitions.

Jayde also represents employers and high-level executives in connection with disputes involving misappropriation of trade secrets, tortious interference, unfair competition and a variety of complex contractual disputes, including those involving requests for emergency injunctive relief.

Representative Experience

  • First-chair experience prosecuting claims for breach of contract and tortious interference against three former employees and a competing entity who began soliciting a client’s customers and employees in order to wrongfully compete in the oil and gas industry, including obtaining an ex parte temporary restraining order and a preliminary injunction.
  • Advised media company on an internal investigation related to claims of workplace harassment, discrimination and workplace violence, and counselled client regarding disciplinary action and employee training resulting from same.
  • Facilitated client training on New York State and New York City sexual harassment laws, and provided counselling regarding the requirements of same to multiple clients in different industries.
  • Successfully resolved claims on behalf of private equity fund brought in the context of a Texas Workforce Commission audit and investigations related to alleged misclassification of independent contractors.
  • Conducted buy-side employment due diligence for technology company, and counseled buyer through post-closing employment improvements, including drafting new policies and procedures, new employee offer letters and other agreements.
  • Negotiated favorable terms for the separation of a C-level executive from a manufacturing company.
  • Represents a technology company, providing practical business solutions and day-to-day advice and counseling on compliance with federal and state anti-discrimination, retaliation and harassment laws; performance evaluations and employee discipline; managing employee leave; protecting confidential and proprietary information; and termination issues.
  • Represents companies regarding labor and employment obligations and in connection with mergers and acquisitions.
  • First-chair experience representing a nationwide retailer in connection with numerous discrimination and retaliation claims.
  • First-chair experience representing a property management company in connection with claims of sexual harassment and retaliation, including negotiating a favorable early resolution of all claims, avoiding extensive discovery.
  • Counselled clients on compliance with employment agreements, including non-solicitation and non-competition provisions.
  • On trial team representing a private equity investment advisor and one of its portfolio company's former executive team and a competitive private equity investment advisor based on corporate usurpation, conspiracy, breach of fiduciary duty and misappropriation of trade secrets in which the client was seeking relief in excess of $700 million.
  • Conducted employment-related trainings to managers and hourly employees on employment law issues.
  • Assisted in successfully defending employers against allegations of discrimination, retaliation, harassment, failure to accommodate, defamation, breach of contract and other violations of state and federal law.
