Profile
Jean Claude Kabera is a Senior Associate at ENS in Rwanda.
He specialises in commercial litigation and dispute resolution (Commercial Arbitration and Mediation). He manages the entire process of clients’ matters from the initial discovery, investigations all the way to plead clients’ cases before courts, negotiating settlements, preparing petition, claims, court submissions as claimant/defendant and assisting or representing clients before the courts of law up to the Supreme Court of Rwanda.
He also advises and assists leading local and international investors in various employment and labour matters which includes advising clients on employment contracts, retrenchment processes, internal rules and employee handbook, outsourcing transactions as well as on employee’s transfer process. He also provides assistance with conciliation sessions before the Labour Inspectorate Office as well as pleading before Chambers dealing with Employment cases.
He also assists local and foreigner clients in land acquisition transactions which include concluding land sale agreements with land owners, attending the transfer before the notary until the investor obtains the land titles or freehold titles which may at later stage be consolidated.
Jean Claude Kabera has acted for various clients (both local and foreign) in Alternative Dispute Resolution mechanism from financial services sector (Banks and Insurance companies), Mining, Real Estate, Construction, Education, Transport, Downstream petroleum industry, Telecommunication as well as IT and Hospitality industries. He has also acted for a wide range of clients in numerous cases pertaining to insolvency proceedings before the commercial courts. He has been consistently appointed and participated as an Insolvency Administrator or Liquidator by the courts. He acted as a consultant at the Supreme Court of Rwanda where he analysed, prepared and published various law reports with the aim of clearing the commercial litigation backlogs and improving the quality of judgements delivered.
Jean Claude Kabera is member of International Bar Association (IBA) and also a member of the Rwanda Bar Association. He is admitted on Kigali International Arbitration Centre (KIAC) Panel of domestic Arbitrators.
Jean Claude is fluent in French, English and is a native speaker of Kinyarwanda.
