Profile

Jennifer M. Misetich is a Shareholder in the Firm’s Los Angeles office. She holds the position of Admin Chair for our Labor & Employment practice group and also serves as the Vice-Chair for our Franchise Law industry group. A seasoned civil litigator, Ms. Misetich provides strategic counsel on all stages of complex labor and employment matters, including class actions, wage and hour disputes, and discrimination, harassment, and wrongful termination lawsuits.

In addition to litigation, Ms. Misetich provides advice and counseling on lawsuit prevention and employment law compliance for her private and public employer clients. She accomplishes this by providing guidance on all facets of employment law including employee handbooks, policies and procedures, high-risk terminations, and severance/release agreements. Ms. Misetich has been named a Southern California Super Lawyers “Rising Star” in Labor & Employment Law every year since 2018, an honor reserved for 2.5% of attorneys in California, either 40 years old or younger or in practice for 10 years or less.

Significant Accomplishments
<ul><li>Obtained a full defense verdict on behalf of client, after a 7-day jury trial in Los Angeles Superior Court.</li><li>Successfully defended and obtained summary judgment in full for City client in a racial discrimination, retaliation, and wrongful termination lawsuit brought by a long-term employee.</li><li>Successfully eliminated claims for intentional and negligent infliction of emotional distress by way of summary judgment in disability discrimination, retaliation, and wrongful termination lawsuit.</li><li>Served as lead questioning attorney in expert witness depositions before trial, which directly resulted in a favorable settlement against a community college district in an employment harassment lawsuit.</li><li>Successfully resolved a lawsuit on behalf of a social services company that discriminated against and wrongfully terminated a former employee, using strategy to attack the employee’s damages claims which resulted in a favorable settlement.</li><li>Represented two post-production entertainment companies in a sexual harassment and age discrimination matter that successfully resolved pre-litigation.</li><li>Defended a manufacturing company in a wage and hour class action involving more than 200 class members, which resulted in a successful settlement.</li><li>Represented and defended a hair color manufacturing company in a wrongful termination lawsuit, which included the successful enforcement of a contractual indemnity provision and partial recovery of the client’s defense costs.</li><li>Negotiated and favorably resolved numerous employment matters involving claims of sexual harassment, discrimination, retaliation, wrongful termination, wage and hour issues, and other claims based on the California Fair Employment and Housing Act and Labor Code.</li><li>Represented and advised numerous public and private clients on high-risk terminations which resulted in litigation prevention.</li></ul>
