Profile

Lindsay counsels employers on a wide range of topics and litigates cases in state and federal courts, including nationwide class and collective actions.

Lindsay focuses on providing practical, effective solutions in day-to-day advice matters and litigation. In addition to experience handling litigation matters in state and federal courts, Lindsay handles administrative matters before federal, state, and local agencies, including the National Labor Relations Board, U.S. Equal Employment Opportunity Commission, Occupational Safety and Health Review Commission and state and local civil rights and occupational safety and health agencies.

Lindsay regularly counsels employers on a variety of employment-related issues, including those related to administering leave policies, complying with accommodation obligations, and developing and administering background check programs. She also regularly assists employers in planning and executing reductions in force, plant closings and mass layoffs. Lindsay also assists in drafting and implementing employer handbooks and policies, as well as severance, employment and restrictive covenant agreements.

In addition to her regular law practice, Lindsay contributes significant time to the firm's pro bono efforts. She is a member of the Washington office Pro Bono Committee and administers the office’s Pro Bono “Attorney of the Day” Program. Through the program, Lindsay and other firm attorneys provide pro bono representation for victims of domestic violence seeking protective orders in the Juvenile and Domestic Relations District Court of Fairfax County, Virginia.

Lindsay is a member of the United States District Court for the Eastern District of Virginia, Western District of Virginia, and the District of Maryland, and is admitted to practice in the District of Columbia and Virginia.

Relevant Experience

  • Defended employers in nationwide and statewide class and collective actions involving wage and hour claims, ERISA claims, and claims under the Fair Credit Reporting Act.
  • Defended employers in state and federal litigation involving claims of discrimination, harassment, retaliation, failure to accommodate, and wrongful termination, among others.
  • Defended employers in investigation and enforcement matters before occupational safety and health agencies and civil rights agencies.
  • Reviewed and assisted numerous clients in revision and/or implementation of background check practices (including on a nationwide basis) in compliance with the Fair Credit Reporting Act and Title VII of the Civil Rights Act, equivalent state laws, and other relevant state and local fair chance and ban-the-box laws.
  • Conducted internal investigations, and advised on internal investigations conducted by third-parties, of discrimination, harassment, unequal pay, and retaliation.
  • Reviewed and advised on position classifications under the Fair Labor Standards Act.
  • Defended unfair labor practice charges before the National Labor Relations Board.
