Thato Maruapula is an Associate at ENS in the Employment practice.

Thato specialises in both litigious and advisory work pertaining to the Employment and Labour Law landscape in South Africa.

His experience includes litigation at the Commission for Conciliation, Mediation and Arbitration (CCMA), various Bargaining Councils, Labour Court, Labour Appeal Court and High Courts of South Africa, due diligence investigations with a focus on employment and occupational health and safety, representing an employer following a fatality at a mine, retrenchments, the dismissal of ordinary and executive employees, structuring of share-scheme incentives and bonuses,  urgent applications to interdict a violent strike, urgent applications to enforce or defend a restraint of trade and drafting and reviewing agreements such as employment contracts, service-level agreements, independent contractor agreements and various human resources (HR) policies and procedures.

In addition, Thato is also experienced in chairing or initiating disciplinary, poor performance and incapacity hearings and has advised clients in the mining, pharmaceutical, media and entertainment, fast-moving consumer goods (FMCG), financial, fintech, metal and engineering sectors and/or industries.

Thato is a member of the South African Society for Labour Law (SASLAW).
