May, 2020 - Jorge De Presno Arizpe, Juan Carlos Serra, Alvaro González-Schiaffino, Rodolfo Barreda and Ricardo Evangelista
In today's Federation's Official Gazette (May 15th, 2020), the Ministry of Health issued modifications to the publication dated May 14th, 2020 in relation to the strategy for the reopening of social, education and economic activities in Mexico.
Modifications are related to the activities that were added to the list of essential activities, namely those in the mining, construction and manufacturing in the transportation industries.
These sectors may restart activities nationwide on June 1st, 2020 if they comply with the following:
a) During the period between May 18th and June 1st, health and safety protocols in the workplace must be prepared and filed in accordance with the guidelines issued by the Secretaries of Health, Economy, Labor, as well as by the Mexican Institute of Social Security .
b) Filing, application and approval of the protocols may take place at the same time that measures for resuming operations are being implemented internally.
c) If the procedure described in the above sections is concluded and approved before June 1st, 2020, then operations can be resumed.
These provisions are measures issued in good faith and failure to comply will result in closure of businesses that put employees' health at risk.
It is not specified where these safety protocols must be filed. It is necessary to be alert to new publications that indicate so.
The Partners, Counsels and Associates of our Labor, Administrative and Health practice groups, together with their associates, are available to comment in more detail the content of this note.
