On 26 March 2021, the Ministry of Labour and Vocational Training (“MLVT”) issued Notification 013/21 (“Notification”) on extending the deadline for foreign employee work permit applications in order to help foreign employees who face difficulties in returning to Cambodia in light of recent COVID-19 outbreak.
Through this Notification, the MLVT has delayed the submission deadline for foreign employee work permit applications until 31 May 2021, being two months after the original deadline.
Please note that the obligation applies to every employer in Cambodia employing foreign employees, including representative offices, branches, private or public limited companies, non-governmental organizations and associations. Failure to comply with the foreign employee work permit requirements could result in fines for each offense of up to USD 630 by the MLVT and/or up to USD 900 by a court. Furthermore, Chapters 5 and 6 of the Law on Immigration provide for a term of imprisonment of up to three months and deportation orders may also be issued to the foreign employees concerned.
Unless you have done so already, we strongly recommend that employers with foreign employees submit foreign employee work permit applications by the above extended deadline.
