Overview

Bradley is a national law firm with a reputation for skilled legal work, exceptional client service, and impeccable integrity. We provide business clients around the world with a full suite of legal services in dozens of industries and practice areas.

Founded in 1870 in Elyton, Alabama, before moving to Birmingham the following year, Bradley has retained the tradition of southern hospitality even as the law firm has grown into a global force. Our founding partners established the highest standards of value, ethics, and professional excellence in the practice of law - standards that have guided us through to the present day. Respect for our clients, colleagues, and communities and passion for our work are the driving forces behind everything we do. That kind of integrity means that clients can trust us to not only serve their needs, but ensure that the work is completed the right way.

Our 10 offices are located in Alabama, Florida, Mississippi, North Carolina, Tennessee, Texas, and the District of Columbia, giving us an extensive geographic base to represent clients on a regional, national, and international basis. We frequently serve as national coordinating counsel, regional counsel, and statewide counsel for clients in various industries.

Diversity and equality in the workforce are core values at Bradley, allowing us to leverage a wide range of perspectives to help us achieve the results that we expect and our clients demand. We are also committed to giving back to our communities with meaningful pro bono legal services and charitable contributions through the Bradley Arant Boult Cummings Charitable Foundation.

Although we are a large law firm with more than 500 lawyers, our clients still enjoy the personal attention, responsiveness, and deep relationships they would expect from a boutique firm. Our attorneys and staff combine legal experience and knowledge with a sophisticated understanding of industries to work side by side with clients and come up with practical, strategic solutions specifically tailored to their business operations. Bradley lawyers use their talents, judgment, work ethic, and experience to go above and beyond expectations to help our clients meet their goals.

You thought you were protected? Enforceability of noncompetes now and in the future

Non-compete clauses in employment agreements have been the source of much controversy over the years. Employers want them to protect their human capital and to prevent competitors from stealing their valued employees. Employees dislike them because they prevent mobility of employment. There are good arguments on both sides. Recently, there have been developments that seem to erode the enforceability of non-competes. This includes a new proposal from the Federal Trade Commission on banning them altogether...

Who Pays For What? Strategically Drafting and Reviewing Operating Expenses and Common Area Maintenance Costs In Commercial Leases

Operating expenses (“OpEx”) and common area maintenance fees (“CAM”) are two important items in any commercial lease, but they are often overlooked after the decision is made on how to split up these fees. Typically, operating expenses are calculated and allocated based on a gross, modified gross, or triple net basis, with the tenant being responsible for a percentage of CAM based on the percentage of the total property they occupy. The landlord will typically have standard lease language for each type of OpEx structure (i.e., gross, modified gross, or triple net) and for CAM breakdowns...

Bruce Ely Quoted in Law360 on MTC Group Activities-Based Sourcing for Partnerships

Bradley attorney Bruce Ely talked with Law360 on a Multistate Tax Commission (MTC) work group’s issue of how to source state income from partnerships and its consideration of a general rule where sourcing would be decided based on the activities of the partnership. Helen Hecht, MTC’s counsel and a staff advisor to the work group, reported that the group was focused on a “default rule,” similar to that found in federal sourcing principles. Under the rule, income would be sourced to the state where the partnership has activities, and so an individual partner's share of that income would also be sourced to that state...

Elisha Kobre Discusses FCA Debate with Law360

Bradley attorney Elisha Kobre talked with Law360 about the Supreme Court’s debate over the False Claims Act punishment for regulatory violations and its impact on fraud enforcement. In two of these cases, whistleblowers have asked the justices “whether and when a defendant’s contemporaneous subjective understanding or beliefs about the lawfulness of its conduct are relevant to whether it ‘knowingly’ violated the FCA...
